1. General provisions
1.1. “Model Regulations on the State-Entrepreneurship Partnership Development Center” (hereinafter - the Regulations) Ensuring the implementation of paragraph 7.2 of the Decree of the President of the Republic of Azerbaijan dated June 26, 2018 No. 148 “On ensuring the activities of the Small and Medium Business Development Agency of the Republic of Azerbaijan” and regulates the activities of the State-Entrepreneurship Partnership Development Center (hereinafter - the Center), which is part of the structure of the Agency for Small and Medium Business Development of the Republic of Azerbaijan (hereinafter - the Agency).
1.2. The Center was established in accordance with paragraph 2.2 of the Decree of the President of the Republic of Azerbaijan dated December 28, 2017 No. 1771 "On further improvement of management in the field of small and medium business".
1.3. The Center operates in accordance with the Constitution of the Republic of Azerbaijan, laws of the Republic of Azerbaijan, decrees and orders of the President of the Republic of Azerbaijan, decisions and orders of the Cabinet of Ministers of the Republic of Azerbaijan, international agreements, other normative legal acts of the Republic of Azerbaijan. takes the lead.
1.4. The Center carries out its activities in connection with the departments and other bodies included in the structure of the Agency.
1.5. The Center participates in the development and implementation of state-entrepreneur partnership programs and projects.
1.6. The staff list and cost estimates of the Center's employees shall be approved by the Chairman of the Management Board of the Agency.
2. Areas of activity of the center
2.0. The activities of the center are as follows:
2.0.1. submission of proposals on the development of the legislative framework and institutional infrastructure for state-entrepreneurial partnership;
2.0.2. development, implementation and coordination of programs and projects on state-entrepreneur partnership;
2.0.3. Ensuring the expansion of SME participation in public-entrepreneurial partnership programs and projects;
2.0.4. educating and strengthening the capacity of all stakeholders in the state-entrepreneur partnership;
2.0.5. analysis, research of projects in accordance with the criteria of state-entrepreneur partnership and work for the implementation of these projects.
3. Duties of the Center
3.0. The Center performs the following tasks in accordance with the directions of activity defined by this Regulation:
3.0.1. Regular analysis of the existing legal framework for business-to-business partnership and the business environment in this area, as well as the development of recommendations and proposals for improving the legislation and the business environment;
3.0.2. Taking into account the priority areas of the country's economy, submission of proposals on potential areas of the state-entrepreneur partnership, which are considered expedient to involve the private sector;
3.0.3. to make proposals on the development of development concepts and perspective development programs in the field of state-entrepreneur partnership, to develop and apply working mechanisms for the implementation of programs and projects in this field;
3.0.4. Develop and apply the necessary rules and guidelines for the development, implementation and evaluation of public-entrepreneurial partnership projects that create conditions for the involvement of SMEs;
3.0.5. Effective coordination of development and implementation of programs and projects on state-entrepreneur partnership with relevant government agencies and other stakeholders;
3.0.6. Determining the minimum share of SMEs in the preparation of state-entrepreneurial partnership projects and making proposals to increase them if necessary;
3.0.7. introduction of priority determination mechanisms for private partners, which will involve SMEs more widely in the implementation of public-entrepreneurial partnership projects;
3.0.8. formation and management of technical assistance mechanism for the purpose of financing the preparation of concept documents, business plans, initial and substantiated feasibility studies, competition and other related documents on state-entrepreneur partnership;
3.0.9. capacity building and provision of consulting services for the development, implementation, monitoring and evaluation of state-entrepreneurial partnership projects;
3.0.10. conducting research and studies on public-business partnership and, if necessary, involving international and local consultants in this area;
3.0.11. monitoring the implementation of state-entrepreneur partnership programs and projects and their implementation providing technical assistance to address deficiencies and difficulties;
3.0.12. Ensuring proper evaluation after the completion of state-entrepreneur partnership programs and projects, determining the effectiveness of projects and submitting relevant reports and proposals;
3.0.13. organization of experience exchange and training visits on state-entrepreneur partnership and ensuring study and application of international best practices in this field;
3.0.14. creation and management of a centralized information database on the state-entrepreneur partnership program, project and all activities in general;
3.0.15. as a knowledge center on state-entrepreneurial partnership, timely, reliable and accurate dissemination of information on state-entrepreneurial partnership policy through various mass media and its regular promotion;
3.0.16. networking and establishing institutional relations with various parties involved in state-entrepreneur partnership projects;
3.0.17. training of professionals in the field of state-entrepreneur partnership, submission of proposals on development of curricula and ensuring effective participation in their implementation;
3.0.18. Ensuring consideration of appeals and inquiries from citizens, state bodies, departments, enterprises and organizations in accordance with the legislation;
3.0.19. submission to the Agency of necessary reports, including reports on the participation of SMEs in public-entrepreneurial partnership projects, assessment of the level of implementation and effectiveness of these projects and action plans;
3.0.20. to conduct research on issues related to the areas of activity, to establish working groups and commissions in coordination with the Agency;
3.0.21. ensuring the application of scientific achievements in the field of public-business partnership, taking into account the best international practices;
3.0.22. Preparation of relevant proposals, reports, references and information for the Agency's management on the Center's activities in accordance with the Agency's strategic development concept.
4. Rights of the Center
4.0. The Center has the following rights to perform its duties:
4.0.1. to make proposals on the adoption, amendment, interpretation, suspension or annulment of normative legal acts in the field of state-entrepreneurial partnership;
4.0.2. submission of proposals on the accession of the Republic of Azerbaijan to international agreements in the field of state-entrepreneurial partnership;
4.0.3. to make proposals on cooperation with international organizations, relevant state bodies (institutions) of foreign countries in order to study the possibility of applying international experience, to study the relevant experience of foreign countries;
4.0.4. taking measures to stimulate the participation of SMEs as suppliers in the implementation of infrastructure projects on public-entrepreneurial partnership;
4.0.5. identification and preparation of state-entrepreneurial partnership projects, as well as preparation of preliminary and substantiated feasibility studies, as well as provision of paid consulting services to interested parties in the preparation of tender documents and other relevant documents;
4.0.6. implementation of paid certified training programs on preparation, management, monitoring and evaluation of state-entrepreneurial partnership projects;
4.0.7. involvement of international and local experts in the development and implementation of state-entrepreneur partnership programs and projects;
4.0.8. to conduct research on issues related to the areas of activity, to be represented in working groups and commissions;
4.0.9. giving opinions and proposals on areas of activity, conducting analyzes and generalizations, preparing analytical materials;
4.0.10. to make proposals on the organization of conferences, meetings, seminars and other events on issues related to the areas of activity;
4.0.11. Representation of the Agency in front of state bodies, local self-government bodies, legal entities and individuals, protection of their rights and interests within the scope of its authority on issues related to the areas of activity
5. Organization of the Center's activity
5.1. The activity of the Center is headed by the Director, who is appointed and dismissed by the Chairman of the Board of the Agency in accordance with the legislation.
5.2. The director of the Center is personally responsible for the implementation of the tasks assigned to the Center.
5.3. Director of the Center:
5.3.1. Organizes and directs the activities of the Center;
5.3.2. Concludes contracts within the powers given by the Chairman of the Management Board of the Agency;
